摘要：循環(huán)經(jīng)濟是21世紀(jì)經(jīng)濟發(fā)展最先進的模式，它從根本上緩解和消除了環(huán)境與發(fā)展之間的矛盾，緩解人類社會的資源矛盾，實現(xiàn)經(jīng)濟活動的生態(tài)化轉(zhuǎn)向。世界上先進國家早在上世紀(jì)就開始對循環(huán)經(jīng)濟進行立法，并通過長期的實踐，制訂了一整套較為完善的循環(huán)經(jīng)濟法律體系。我國與發(fā)達國家相比，循環(huán)經(jīng)濟發(fā)展較為落后，目前還處在源頭防污的清潔生產(chǎn)階段，在法律體系上，只頒布施行了《清潔生產(chǎn)促進法》，而且該部法律條文內(nèi)容較為原則，無實施細則。我國建筑業(yè)在循環(huán)經(jīng)濟方向還處于從末端治理向源頭防治的過渡階段，我國建筑業(yè)的現(xiàn)狀按清潔生產(chǎn)的要求還存在較多不完善，對人類健康和環(huán)境污染的現(xiàn)象也尚未完全得到有效控制，故在我國建筑業(yè)大力促進清潔生產(chǎn)是十分緊迫且十分重要的。結(jié)合發(fā)達國家循環(huán)經(jīng)濟的立法和模式的成功經(jīng)驗，對我國建筑業(yè)促進清潔生產(chǎn)，發(fā)展循環(huán)經(jīng)濟提出了制訂《建筑業(yè)清潔生產(chǎn)促進法》，制訂和調(diào)整建筑業(yè)有關(guān)規(guī)范和標(biāo)準(zhǔn)，根據(jù)清潔生產(chǎn)要求修改《建筑法》，制訂相關(guān)的規(guī)章制度等法律建議，使我國建筑業(yè)真正做到清潔生產(chǎn)，快速實現(xiàn)循環(huán)經(jīng)濟。

Abstract:Circulationeconomyisthemostadvancedeconomicdevelopmentmodelinthe21#century.Italleviatesandeliminatesthecontradictoryrelationshipbetweenenvironmentanddevelopment,alleviatingthescarcenessofresourcesinhumansociety,andachievingecologicaltransitionofeconomicactivities.Developedcountriesbegantolegislateforcirculationeconomyfromlastcentury,andhaveestablishedaperfectlegalsystemforitthroughlong-paredwiththecirculationeconomyindevelopedcountries,thecurrentsituationinChinaislessadvanced,andisstillatthestageofcleanproduction,whichonlyfunctionsasinitialprevention.Fromtheperspectiveoflegalsystem,ChinesegovernmentjustenactedtheLawofAdvancingCleanProduction,whichonlycontainsprincipledarticlesinsteadofdetailedaccountsforexecution.Fromtheviewpointofcirculationeconomy,constructionindustryinChinahasnotsurpassedthelevel,onwhichthefinalregulationoradministrationistransitingtowardstheinitialprevention.InaccordancewiththeLaw,thecurrentsituationofconstructionindustryinChinahasnotfulfilledthelegalrequirementsfully,andthephenomenaofhumanhealthandenvironmentalpollutionhavenotbeenundercontrolcompletelyyet,biningthesuccessfulexperiencesoflegislationandmodelsofcirculationeconomyindevelopedcountriesandthecurrentsituationsinChina,thisresearchproposestoestablishtheLawofAdvancingCleanProductioninConstructionIndustry,tosetupandadjuststandardsinconstructionindustry,toamendtheLawofConstruction,andtoestablishrelevantregulationsandpolicies,inordertoachievecleanproductioninconstructionindustryandacceleratetherealizationofcirculationeconomyinChina.
